International Arbitration & Foreign Awards
Indian counsel for cross-border arbitration, and for the enforcement of foreign awards before the Indian courts.
Where a dispute has an Indian connection — an Indian counterparty, assets in India, or a contract performed here — the arbitration itself is only part of the problem. What decides the outcome is often what the Indian courts do before, alongside and after it: whether interim protection can be obtained over assets in India, which court supervises the reference, and whether an award made abroad can be turned into money. We act for international businesses, investors and foreign counsel on that Indian dimension, both as counsel in the arbitration and in the connected proceedings before the Indian courts.

How a matter of this kind proceeds
The Indian question, isolated
1–2 weeksThe first task is to establish what actually turns on Indian law. The seat determines which courts supervise the arbitration; where the seat is outside India, the Indian courts have a defined and limited supporting role rather than a general one. That single question governs which of the steps below are open to you.
Securing the position in India
Urgent applications are heard on an expedited basisWhere there are assets or a presence in India, interim protection is usually the step that has to be taken first and quickly, because it is what stops the dispute becoming academic. This is available in support of a foreign-seated arbitration unless the parties have excluded it by agreement — which is a question of construction of the clause, and is worth settling before anything is filed.
The arbitration itself
Statutory timeline applies to an India-seated awardWhere the reference is seated in India, the proceedings run under Part I: constitution of the tribunal, pleadings, evidence and hearings under the tribunal's procedural orders, with recourse to the court for the appointment of arbitrators and for evidence where a party will not co-operate. Where it is seated abroad, our role is ordinarily to advise on the Indian law issues in it and to prepare the ground for what follows.
Enforcement of the award
Limitation runs from the award; do not assume it is longA foreign award falling within Part II is enforced by application to the court having jurisdiction, supported by the original award and arbitration agreement with certified translations where required. Enforcement and execution are a single proceeding rather than two, so a separate execution petition is not needed once the award is held enforceable. The grounds on which enforcement can be resisted are exhaustive and narrow, and do not include re-arguing the merits.
Timelines are indicative only. Listing and hearing dates are set by the court or tribunal concerned and are outside the firm’s control.

Common questions
We have an award against an Indian company. How do we actually get paid?
An award made in a country that India has notified as a reciprocating territory under the New York Convention is enforced by applying to the court that would have jurisdiction over the subject matter — in practice, most often the High Court where the assets or the company are. Once the court is satisfied the award is enforceable it is treated as a decree of that court and executed as one, in the same proceeding. The two practical variables are whether limitation has been observed and whether assets can be identified before the counterparty moves them, which is why the enforcement application and the search for assets are usually planned together.
On what grounds can an Indian court refuse to enforce a foreign award?
The grounds are set out exhaustively in the statute and mirror the New York Convention: incapacity of a party, invalidity of the arbitration agreement, want of proper notice or inability to present a case, the award going beyond the scope of the reference, irregular constitution of the tribunal or procedure, the award not yet being binding or having been set aside at the seat, non-arbitrability, and conflict with the public policy of India. Public policy in this context is deliberately narrow and does not permit a review of the merits or a second look at the tribunal's findings of fact.
Can an award made outside India be challenged in an Indian court?
No. The application to set aside an award is available against awards made in India; it is not a route for attacking a foreign award, which can only be challenged before the courts of the seat. What an Indian court can do is decline to enforce a foreign award on the statutory grounds. The distinction matters when a party is deciding where to spend its effort, and it is the point most often misunderstood on both sides.
Our arbitration is seated in Singapore. Can we still get an injunction over assets in India?
Ordinarily yes. The provisions allowing a court to grant interim measures apply to a foreign-seated international commercial arbitration unless the parties have agreed otherwise, so relief over Indian assets remains available in support of an arbitration held elsewhere. Whether your clause amounts to that agreement to the contrary is a question of construction, and it is better answered before the application is drafted than in reply to the objection.
Is an emergency arbitrator's order worth anything in India?
Where the arbitration is seated in India and the parties have adopted institutional rules providing for an emergency arbitrator, an order made by one has been treated as enforceable through the same route as an interim order of the tribunal itself. The position for an emergency award made in a foreign-seated arbitration is less settled, and the practical answer there is often to seek interim relief from the Indian court directly rather than to litigate the enforceability of the emergency order.
How long do we have to enforce a foreign award in India?
A limitation period applies and it is shorter than parties usually assume — it is measured in years from when the right to apply accrues, not from when the counterparty stops paying or when settlement talks break down. Delay can be condoned only on sufficient cause shown, which is not a formality. If you are holding an award and negotiating rather than enforcing, the date to check is the one that has already started running.
We are foreign counsel. What can Indian counsel actually do for us?
Foreign lawyers cannot appear before the Indian courts, so anything requiring a filing or an appearance here needs Indian counsel on the record. Beyond that, the usual work is advice on Indian law issues arising within an arbitration held elsewhere — validity of the clause, arbitrability, capacity, the effect of Indian mandatory law on the contract — and preparing the enforcement route in India before the award is made rather than after, which is normally the difference between an award that is collected and one that is not.
