What To Bring

Typical information that helps us assess a matter of this kind:

  • Purchase or service-related documentation
  • Correspondence with the opposite party
  • A clear statement of the grievance and relief sought

How a matter of this kind proceeds

01

Forum and limitation

The value of the claim determines whether the complaint lies before the District, State or National Commission, and the limitation period runs from when the cause of action arose.

1 week
02

Notice and complaint

A notice is ordinarily issued, and the complaint filed with the supporting documents and an affidavit.

2–4 weeks
03

Reply and evidence

The opposite party files its version, evidence goes in by affidavit, and the proceedings are designed to be summary in nature.

Governed by commission listing
04

Order and appeal

Relief may include refund, replacement, compensation and costs. An appeal lies to the next commission in the hierarchy.

Appeal period fixed by statute

Timelines are indicative only. Listing and hearing dates are set by the court or tribunal concerned and are outside the firm’s control.

Common questions

Do I need a lawyer for a consumer complaint?

The forum is designed to be accessible and you may appear in person. Representation tends to matter where the amount is significant, the opposite party is represented, or the matter involves contested expert or technical evidence.

How long do I have to file?

A limitation period applies, running from the date the cause of action arose. Delay beyond it can be condoned only on sufficient cause being shown, which is not a formality — so the practical answer is not to rely on it.

Can I complain about a delayed flat?

Delayed possession by a builder can found a consumer complaint as a deficiency in service, and it may equally lie before the RERA authority. The two routes offer different relief and cannot both be pursued for the same cause, so the choice is worth making deliberately.
